License Agreement

To use this product you must read and agree to be bound by this License Agreement.

If you do not agree, please cancel the installation and delete your copies of the software.

This product, including all software programs, data, printed or electronic documentation, is licensed to you the legal entity of the end user, pursuant to the terms of this License Agreement. This License Agreement is a legal Agreement between you and Pep Talk International Pty Ltd ABN 29 117 499 322, of 288 Glen Osmond Road, Fullarton 5063, South Australia, Australia (hereinafter called “Pep Talk”).

By installing, copying or otherwise using any part of the product you agree to be bound by these terms:

1. All copyright and intellectual property right in the product is and remains the property of Pep Talk. Pep-Talk is a patent and trademark of Skunkworks Australia Pty Ltd licensed to Pep Talk.

2. The product may only be used by you in accordance with its intended use as described in the information on Pep-Talk Everywhere provided on the website at www.pep-talk.com.au

3. The product is not sold to you, but rather it is licensed to you to be used in accordance with the terms of this Agreement. This license automatically terminates if you breech any of the terms of this Agreement or you are notified that Pep Talk has terminated this license. Upon termination of this license you must immediately stop using the product and delete all copies of the product in your possession or control.

4. You must not sell, loan, rent, lease, transfer, assign or sub-license the product without the prior written consent of Pep Talk.

5. You must not attempt, or allow, or cause a third party to decompile, disassemble, reverse engineer, copy, reproduce, transmit or modify the product in whole or in part. You may make one copy for back-up purposes.

6. Product support is not provided to you under the terms of this Agreement. Support is available under a separate agreement.

7. To the extent permitted by law, Pep Talk excludes all warrantees and representations relating to the product. Pep Talk does not make representation or give any warranty as to the content, accuracy, commercial benefit to you, or the suitability of the product for your intended use. To the extent permitted by law, Pep Talk shall not be liable in contract or in tort, including negligence, or otherwise, for any loss or damage, business interruption, lost profits or goodwill, lost or corrupt data, including indirect or consequential loss or damage, however caused, which may be suffered, or incurred or which may arise directly or indirectly in respect of the use of or inability to use the product.

8. To the extent permitted by law, Pep Talk excludes you from any other rights in relation to the product.

9. This Agreement is governed by the laws of South Australia.
